Rules of the Game
NO PURCHASE OR DONATION NECESSARY TO ACQUIRE A RAFFLE TICKET. MAKING A PURCHASE/DONATION WILL NOT IMPROVE THE CHANCES THAT ANY GIVEN TICKET ACQUIRED WILL BE THE WINNING TICKET
OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES, WHO ARE 18 YEARS OF AGE OR OLDER OR AGE OF MAJORITY IN THEIR JURISDICTION OF RESIDENCE, WHICHEVER IS OLDER. DO NOT REGISTER FOR OR USE RAFFLE NETWORK IF YOU DO NOT MEET THESE ELIGIBLITY CRITERIA.
WHILE THE SITE AND RELATED MATERIALS USE THE WORD “RAFFLE” IN VARIOUS CONTEXTS IN CONNECTION WITH THE SERVICES BEING OFFERED, IN FACT THE GAMES OFFERED ON THIS SITE ARE NOT A TRUE “RAFFLE” BUT ARE RATHER CONSIDERED A “SWEEPSTAKES” BECAUSE RAFFLE NETWORK OFFERS ALL PARTICIPANTS THE OPPORTUNIITY TO ENTER ANY GAME FOR FREE. AS A RESULT THE GAMES OFFERED ON THIS SITE ARE NOT SUBJECT TO LOTTERY, ONLINE GAMING OR OTHER SIMILAR LAWS. ALL ORGANIZERS AND OTHER PARTICIPANTS ARE ENCOURAGED TO OBTAIN INDEPENDENT LEGAL ADVICE AS TO THESE MATTERS BEFORE PARTICIPATING IN ANY GAME.
1. Raffle Network, 100 Cambridge Street, 14th Floor, Boston, MA 02114. (“Company” or “Raffle Network”).
(a) Raffle Network facilitates donations for school sports teams, clubs and other entities organized under Section 501 (c) (3) of the Internal Revenue Code (“501(c) (3) Organizations”) as well as for-profit organizations by facilitating sweepstakes promotions on their behalf (all such entities are referred herein as “Organization(s).”.
(b) Individuals may enter these sweepstakes promotions by purchasing a ticket (resulting in a donation to an Organization) OR without purchase. Regardless of whether (or not) a Raffle ticket is purchased, all entrants will have the same chances of winning the available prize(s) in a given sweepstakes promotion. These sweepstakes promotions are identified as “Raffles” solely for purposes of convenience even though the purchase of a ticket is NOT required to participate in any sweepstakes promotion.
(c) Each Raffle is governed by its own set of Raffle Regulations, which set forth the details of a specific Raffle, including but not limited to:
(1) The duration (start and end dates/times) of that Raffle;
(2) Any limit on the quantity of Raffle tickets that may be obtained by a given person;
(3) The approximate date of the random drawing to determine the winner(s) of that Raffle;
(4) The quantity and type of prizes available to be won in a given Raffle;
(5) The specific details of prize award, such as whether a prize will be payable at one single time or in installments;
(6) Any business entity that is partnering with an Organization in conjunction with offering of a Raffle.
The Raffle Regulations are made a part of these Official Rules and incorporated herein by reference. In the event of any inconsistency between these Official Rules and the Raffle Regulations, the Raffle Regulations shall prevail, govern and control only with respect to the conduct of that particular Raffle; in all other cases, these Official Rules shall prevail, govern and control.
3. How To Enter A Raffle:
(a) Visit the Raffle Network website at https://www.rafflenetwork.com/ (If you access the Raffle Network website via mobile device, message and data rates and other charges may apply. Any and all such charges are your sole responsibility. You are therefore strongly advised to review your wireless carrier’s rate plan before downloading the App or accessing the Raffle Network website via mobile device. Wireless Internet access is not available on all devices or in all areas so your access to Raffle Network may be limited until you are able to reconnect to the internet.)
(b) Select a Raffle for that Organization. After clicking the Enter Raffle button, you will be taken to a page with the Raffle Regulations for that Raffle. IN ORDER TO PROCEED FURTHER IN THE ENTRY PROCESS (WHETHER OR NOT YOU WISH TO PURCHASE RAFFLE TICKET[S]), YOU MUST INDICATE THAT YOU HAVE READ, UNDERSTAND AND FULLY AGREE TO THE RAFFLE REGULATIONS GOVERNING THAT RAFFLE. (Make sure this is in place on the website)
(d) Indicate whether you wish to purchase Raffle tickets (and, if so,
how many tickets you wish to purchase) or to claim Free Raffle ticket(s). Raffle ticket(s) must
be purchased or Free Raffle ticket(s) claimed by the entry deadline for a given Raffle as set forth
in the Raffle Regulations.
If purchasing “Raffle” ticket(s): When prompted, provide a valid credit card number, expiration date and security code to purchase Raffle ticket(s). Once Raffle Network receives credit card authorization***, you will be sent via e-mail a receipt with the number(s) of Raffle ticket(s) purchased and a link to the virtual Raffle ticket(s) purchased, and a snapshot of significant information regarding that Raffle (e.g., approximate date of random drawing).
If claiming Free ticket(s): You will receive via e-mail a receipt with the number(s) of Free ticket(s) claimed, a link to the virtual Raffle ticket(s) claimed, and a snapshot of significant information regarding that Raffle.
(Allow approximately 5 minutes to receive the Raffle ticket receipt via e-mail. Individuals are advised to add firstname.lastname@example.org to their “Safe Senders” or like list so that the Raffle ticket receipt is not classified as “junk” or “Spam.” A Raffle ticket receipt is only binding upon Raffle Network to the extent that it indicates that a given individual has purchased or claimed free Raffle ticket[s] and, as such, does not constitute any representation as to eligibility for any Raffle or selection of an individual as a prize winner in any Raffle.)
*If you receive an e-mail from an authorized representative of a 501 (c) (3) Organization, clicking on the hypertext link in the e-mail may take you directly to that 501 (c) (3) Organization’s page on the Raffle Network website.
**Alternatively, instead of providing their contact information for each specific Raffle he/she is interested in, a person may register once with Raffle Network for expedited purchase or free claiming of Raffle ticket(s). Registration enables a person to sign in for multiple Raffles by providing the username and password which they obtained at the time of registration with Raffle Network.
***Notwithstanding such initial credit card authorization, should the credit card transaction later be rejected by the entity processing same, Raffle ticket(s) purchased via such credit card transaction will be void.
4. Additional Restrictions on Raffle Entry:
(b) Use of automated, programmed or other like means (such as, third party sweepstakes entry services) to purchase Raffle ticket(s) or claim free Raffle tickets in any Raffle, including violation of the entry limit for a Raffle (as applicable), will result in the voiding of all entries/Raffle tickets determined by Sponsor in its sole and absolute discretion to be irregular. In addition, Sponsor will NOT offer a refund for any Raffle ticket purchases determined to be irregular. Further, should Sponsor determine that Raffle ticket purchase(s) or Free Raffle ticket claims are irregular, Sponsor reserves the right to revoke a given individual’s registration with Raffle Network (if applicable), as well as barring such person from participating in any other Raffles; and, Raffle Network may also pursue any and all available legal remedies and sanctions against such person including criminal and/or civil prosecution.
(c) Raffle ticket(s) are non-transferable and, as such, are good only for the original recipient of same directly from Raffle Network. Any purported transfer of Raffle ticket(s) voids such Raffle ticket(s) and is not binding upon Raffle Network. For the avoidance of doubt, any such purported transfer of Raffle ticket(s) constitutes an irregular Raffle ticket claim as per Rule 4(b) above.
(d) Should a dispute arise, the individual who provided his/her contact information in purchasing/claiming free Raffle ticket(s) as per Rule 3(d) above will be deemed to be the purchaser/claimant of such Raffle ticket(s).
(e) It is the participant’s sole responsibility to confirm that the e-mail address and street address provided to Raffle Network are current, whether provided as part of registration with Raffle Network or when entering a specific Raffle. Sponsor expressly disclaims any and all liability for late, lost, misdirected, delayed, undeliverable or otherwise defective communications (including Raffle ticket receipts, winner notifications and prizes) due to incomplete, outdated or otherwise inaccurate address information.
5. Random Drawings/Odds:
(a) For each Raffle, the winner(s) will be selected in a random drawing from among all eligible entries/Raffle tickets purchased and freely claimed. The random drawing will be conducted by Company on or about three (3) business days after the conclusion of a given Raffle.
(b) Potential winner(s) will be notified via e-mail.Potential winner may also be required to complete, sign and return an Affidavit of Eligibility, a Liability Release and a Publicity Release (where lawful) within five (5) business days of notification or other indicated time period. In the event of noncompliance with the prize claim procedure, the Affidavit/Release requirement (if applicable), if potential winner cannot be contacted for any reason or if potential winner is determined by Company to be ineligible or otherwise in violation of these Official Rules (including the applicable Raffle Regulations), he/she will be disqualified and forfeit the prize without compensation of any kind. In case of prize forfeiture, an alternate winner will be selected from among all remaining eligible entries received/Raffle tickets purchased and freely claimed for the applicable Raffle.
(c) While a certain fixed number of Raffle tickets will be made available for distribution via purchase or free claim for each Raffle, the odds of winning a (or the, as the case may be) prize in a given Raffle random drawing depends on the total number of eligible entries (i.e., Raffle tickets actually distributed by Raffle Network) for that Raffle.
6. Prize Restrictions:
(a) Prizes will be awarded in the form of a check; but, Organization reserves the right in its sole and absolute discretion, to award prizes as a cash equivalent of some other kind (e.g., prepaid debit card from an accredited financial institution of Organization’s sole choosing) by including a notice to such effect in the Raffle Regulations of the affected Raffle(s). Check will be sent to prize winner at his/her street address in the fifty (50) United States or Washington, DC. Organizer has sole responsibility to send the check or prize to winners,
(b) Any and all expenses related to acceptance and use of prize are the prize winner’s sole responsibility, and it is the responsibility of the Organization to send any prizes awarded. Raffle Network assumes no liability for any actions that it is not specifically responsible for as set forth in these Rules of the Game or the Terms and Conditions, including but not limited to the delivery of any and all prizes awarded in any Game.
(c) Any and all taxes on prize(s) are the sole responsibility of the prize winner; and, should a given individual win a prize in a given Raffle (or win prizes in multiple Raffles, whether or not in support of the same Organization) during a given calendar year which equal or exceed $600, he/she will be issued an Internal Revenue Service 1099 Form reflecting his/her receipt of such prize(s). The Internal Revenue Service 1099 Form is in addition to any tax documents that may be issued to winner by the Organization on whose behalf a Raffle was conducted. By participating in any Raffle, you agree to fully cooperate with Sponsor and/or Organization as to compliance with any and all applicable Internal Revenue Service reporting requirements including the provision of your Social Security Number.
(d) Sponsor and Organization make no representation, warranty or guarantee of any kind that any Raffle ticket purchased is eligible for a charitable deduction or other form of favorable tax treatment. You are strongly advised to consult with your accountant or tax professional before claiming any charitable deduction or favorable tax treatment based on the purchase of Raffle tickets for any Raffle.
(e) In certain Raffles where the raffle ticket sellers are unsuccessful in raising enough money to fund the prize(s) that are being offered in connection with that particular Raffle, the Raffle shall revert to a 50/50 type contest wherein the published prizes will no longer be awarded and there shall be only one winner who shall receive 50 % (fifty percent) of the net proceeds from the ticket sales from that Raffle. Whether a Raffle reverts to a 50/50 format shall be left to the sole discretion of the Organizer whose decision is final and not subject to any kind of appeal or reconsideration.
(a) Except where prohibited by law, by accepting prize, winner agrees (and will confirm in writing upon request) to use by Sponsor and its designees (including the applicable Organization and any business entity partnering with such Organization) of his/her name, likeness, photo, voice, biographical information, image, statements about Raffle Network, the applicable Organization, any business entity partnering with such Organization, or the Raffle itself and other indicia of his/her persona for advertising/publicity/trade/promotional purposes by Sponsor and its designees (including the applicable Organization and any business entity partnering with such Organization) without further compensation or notice of any kind.
(b) By participating in any Raffle and using the Raffle Network website or App, a person releases and agrees to hold harmless Sponsor, the applicable Organization and any business entity partnering with such Organization, their respective parent companies, affiliates, subsidiaries, divisions, and the directors, officers, agents, representatives, shareholders, employees, successors and assigns of any of the above organizations from any and all liability arising from participating in any Raffle; using the Raffle Network website and/or App; any Raffle-related activity or the acceptance, receipt, possession, use or misuse of any prize(s), as applicable.
8. Additional Conditions:
(a) Employees, officers and directors (and their immediate families, defined as parents, spouses, children and siblings and their spouses) of Sponsor, its parent, affiliates, subsidiaries, agencies or independent contractors involved in any way in the development, production or distribution of the Raffle Network website are NOT eligible to purchase/claim free Raffle tickets for ANY Raffle.
(b) Employees, officers and directors (and their immediate families, defined as parents, spouses, children and siblings and their spouses) of a given Organization or any business entity partnering with such Organization; and, as applicable, their respective parent, affiliates, subsidiaries, agencies; are NOT eligible to purchase/claim free Raffle tickets for ANY Raffle supporting such Organization. Volunteers for a given Organization ARE eligible to purchase/claim free Raffle tickets for any Raffles supporting that Organization.
(c) The game is prohibited and void where prohibited by law.
9. Limitations of Liability:
(a) Raffle Network’s system is the official clock for all Raffles and all times are EST.
(b) Raffle Network and its designees (including applicable 501 (c) (3) Organization and any business entity partnering with such 501 (c) (3) Organization) assume no responsibility under any legal theory for any of the following:
(1) any incomplete, incorrect or inaccurate information whether caused
by the Raffle Network website or App users, tampering, hacking or by any of the equipment or
programming associated with or utilized in any Raffle or the Raffle Network website or App
itself or by any technical or human error of any kind regardless of cause;
(2) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of the Raffle Network website or App, or in the conduct, distribution or implementation of any Raffle;
(3) any problems or technical malfunctions of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, programming or failure of e-mail (whether sent to or from participant) on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof;
(4) any injury or damage to a participant’s or any person’s computer or mobile device (or any information/materials stored therein) related to or resulting from downloading materials from the Raffle Network website or App or otherwise resulting from participation or attempted participation in any Raffle;
(5) Late, lost, illegible/garbled, incomplete, damaged, inaccessible, misdirected, corrupted or jumbled e-mail transmissions (whether sent to or from participant) or entries/Raffle tickets regardless of cause (all of same being void).
(c) Force Majeure. If, for any reason (whether or not reasonably foreseeable by Raffle Network), any Raffle cannot be conducted as originally planned due to circumstances beyond Raffle Network’s control as determined by Raffle Network in its sole and absolute discretion (including, by way of example, only, natural disaster, riot, strike, civil commotion, materials shortage, governmental intervention, technological failure/malfunction, fraud, terrorist activity or the threat of same), Raffle Network reserves the right to cancel, terminate, modify or suspend affected Raffle(s) and to select prize winner(s) for such affected Raffle(s) from among all eligible entries/Raffle tickets purchased or freely claimed for such affected Raffle(s) prior to and/or after Raffle Network’s action or otherwise in a manner determined by Raffle Network in its sole and absolute discretion to be fair, appropriate and consistent with these Official Rules (including the Raffle Regulations for the affected Raffle[s]). Notice of such action by Raffle Network will be posted on the applicable 501 (c) (3) Organization page on the Raffle Network website and App.
(d) Should Raffle Network fail to enforce a given provision of these Official Rules (including the Raffle Regulations for any Raffle) in a particular circumstance, such non-enforcement shall NOT constitute a waiver of such provision by Raffle Network.
(e) CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE THE RAFFLE NETWORK WEBSITE (INCLUDING THE MOBILE VERSION OF SAME), THE APP OR TO UNDERMINE THE LEGITIMATE OPERATION OF ANY RAFFLE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND/OR THE APPLICABLE 501 (C) (3) ORGANIZATION AND/OR ANY BUSINESS ENTITY PARTNERING WITH SUCH 501 (C) (3) ORGANIZATION EACH RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Dispute Resolution/Choice of Law:
To the fullest extent permitted by law, by using the Raffle Network website or App and participating in any Raffle, you agree that:
(1) any action at law arising out of or relating to use of the Raffle Network
website or App or any Raffle offered thereon, as well as these Official Rules (including the Raffle
Regulations of any given Raffle) shall be filed exclusively in the U.S. District Court for the District
of Massachusetts (in Boston, Massachusetts) or Massachusetts State Court in Suffolk County, Massachusetts
and you hereby consent and submit to the personal and exclusive jurisdiction of such courts for the
purposes of litigating any such action;
(2) any such action shall be resolved individually, NOT as part of a class action, with all rights of any person or Organization who wishes to bring a class action against Raffle Network or Community Connections Group or any of its officers or directors being hereby waived ;
(3). Notwithstanding anything to the contrary in the this, Raffle Network shall have the sole and unlimited right (but not obligation) to compel the dismissal of any lawsuit(s) filed by you, upon notice to you through the lawsuit or otherwise that said dispute be subject to binding arbitration before an arbitrator of Raffle Network’s choice, with said arbitration to take place, in person, in Boston, Massachusetts. You agree that this remedy may be asserted by Raffle Network in any said lawsuit that may be filed via a Motion to Compel arbitration, a motion to dismiss, and/or other appropriate legal process.
(4) any claims/judgments/awards shall be limited to actual out-of-pocket costs incurred, but NOT attorneys’ fees;
(5) you have no right to enjoin or restrain the development, implementation, conduct, advertising, promotion or exploitation of any Raffle or of the Raffle Network website or App generally based on any alleged violation of these Official Rules (including the Raffle Regulations of a given Raffle) by Sponsor, the applicable 501 (c) (3) Organization or any business entity partnering with such 501(c)(3) Organization (i.e., YOU WAIVE ANY CLAIM TO INJUNCTIVE RELIEF);
(6) any action at law arising out of or relating to use of the Raffle Network website or App or any Raffle offered thereon, as well as these Official Rules (including the Raffle Regulations of any given Raffle) shall be governed by the laws of the Commonwealth of Massachusetts, without regard to principles of choice of law/conflict of laws of Massachusetts (or any other jurisdiction which would result in the application of the laws of any jurisdiction other than that of the Commonwealth of Massachusetts).
If the preceding or any other provision of these Official Rules (including the Raffle Regulations of any given Raffle) is determined by a court or arbitrator of competent jurisdiction to be invalid, illegal or unenforceable, it shall be replaced by a substitute provision that most closely approximates the original intent of Sponsor and is valid, legal and enforceable. The invalidity/illegality/unenforceability of a given provision shall not affect the remainder of these Official Rules; without limiting the foregoing, the invalidity/illegality/unenforceability of any provision of the Raffle Regulations of a given Raffle will not affect the validity/legality/enforceability of the Raffle Regulations of any other Raffle.
11. Winners List:
For the first name/last initial and city/state of the winner(s) of a given Raffle, mail a self-addressed stamped envelope to 100 Cambridge St 14th Floor, Boston, MA 02114 for receipt no later than five (5) business days after the drawing date for that Raffle as set forth in the Raffle Regulations for that Raffle. Be sure to specify the date and the 501 (c) (3) Organization of the Raffle you are inquiring about. Winners list will be available for three (3) weeks after the drawing for a given Raffle.
